تجربه مشاوره اجباری بین متقاضیان طلاق توافقی در شهر تهران

چکیده

امروزه تغییر و تحول در خانواده ها، موجب گردیده که شروع زندگی و نیز شیوه پایان بخشیدن به آن، اشکال مختلف به خود بگیرد. با توجه به افزایش طلاق توافقی در بین زوجین، قانونگذار برای کاهش آسیب ها و پیامدهای آن سعی نموده اقداماتی را بیندیشد. ارجاع به مراکز مشاوره از جمله برنامه هایی است که در سال 1397 برای کاهش طلاق در شهر تهران از سوی مراکز دادگاه اجباری شده است. مطالعه حاضر با هدف بررسی تجربه مشاوره در بین زنان و مردان متقاضی طلاق توافقی به روش تحلیل روایت و به صورت نمونه گیری هدفمند انجام گرفته است. یافته های حاصل پیرامون تجربه های زنان از مراجعه به مراکز مشاوره در سه مرحله: اول؛ تصمیم برای جدایی؛ دوم، بازوهای مشاوره قضایی؛ سوم، اتفاق طلاق توافقی قابل تحلیل می باشد. در واقع شروع نابهنگام زندگی و داشتن روابط فرازناشویی در کنار مداخله خانواده ها موجب فاصله گرفتن زوجین از همدیگر، زمینه های رویداد طلاق را فراهم می آورند.

Today, changes in families have begun to take on different forms, both beginning and ending. Given the increasing divorce rate among couples, the legislator has been trying to think of measures to reduce the harm and its consequences. Referral to counseling centers is one of the programs that have been compulsory by court centers in Tehran in 1997 to reduce divorce. The purpose of this study was to investigate the experience of counseling between men and women applying for divorce through narrative analysis method and purposeful sampling. Findings about women's experiences of referral to counseling centers are analyzed in three stages: first; the decision to divorce; second, the arms of judicial counseling; and third, the agreement on divorce. In fact, premature start of life and having meta-marital relationships along with the intervention of the families make the couple divorced, providing grounds for the divorce event. In the meantime, applying for a divorce agreement is another stage of compulsory separation counseling, which can be termed overtime counseling, which in most cases leads to an inability to reach a solution.
