Marital rape is a subject that The United Nations has warned to fight against it in the form of declaration on the Elimination of Violence against Women. However, due to the growing number of countries that has criminalized marital rape, this has become close to the border of an international norm; the needs to identify this phenomenon based on psychological juridical and legal documents are essential in our society. So this research tries to find an adequate response to the main question of the study: How marital rape in psychological perspective could be in Islamic law and jurisprudence? In this regard library studies on juridical and legal resources were done, and then a combination of research methods or mixed (combination of qualitative and quantitative) and exploratory data analysis method is used. In this way through in-depth interviews with four victims, central issues have been extracted, and they have been explaining psychologically. Since then “common practice” is a powerful factor in the attitude of jurisprudence and law; based on central issues of collect data a questionnaire has been extracted. Then Questionnaires have been answered by 100 experts that have been involved in this area.
